Terms and Conditions – Lania Boutique

Article 1: Definitions

  • Withdrawal period: The period in which the consumer can withdraw from the contract without giving any reason.

  • Consumer: A person who enters into a contract for personal purposes, outside of trade, business, or profession.

  • Day: Calendar day.

  • Long-term transaction: A contract for the regular supply of goods or services over time.

  • Durable medium: Any tool that allows information to be stored and retrieved unchanged in the future.

  • Right of withdrawal: The consumer’s right to cancel the contract within the withdrawal period.

  • Entrepreneur: A natural person or company offering goods or services remotely to consumers.

  • Distance contract: A contract concluded without physical presence using remote communication.

  • Means of distance communication: Any means by which an agreement can be concluded without both parties being physically present.

  • Terms and Conditions: These terms, drafted by the entrepreneur, that apply to the conclusion of any contract.

Article 3: Applicability

  1. These terms apply to every offer, agreement, and distance order between Lania Boutique and the consumer.

  2. Before entering into a distance contract, the consumer is given access to these terms.

  3. If it is not reasonably possible to provide the terms beforehand, it will be indicated where they can be inspected.

  4. In the case of electronic contracts, the terms can be provided digitally for easy storage.

  5. In case specific product or service conditions apply, the most favorable provision to the consumer prevails in case of conflict.

  6. If a provision is invalid, the contract remains effective, and a similar provision will replace it.

Article 4: The Offer

  1. All offers are non-binding.

  2. Product images, descriptions, and data are indicative and non-binding.

  3. Obvious errors do not bind Lania Boutique.

  4. Detailed information is provided to enable informed decision-making.

  5. Colours on the website may differ from the actual product.

  6. Limited-time offers and conditions will be clearly mentioned.

  7. The consumer is informed about:

    • Prices (excluding customs and import GST, borne by the customer)

    • Shipping costs

    • Customs handling (import GST, duties are the customer's responsibility)

    • How the contract is formed

    • Right of withdrawal

    • Payment and delivery procedures

    • Validity period of the offer

    • Archiving of the contract and consumer’s access to it

    • Languages in which the contract may be concluded

    • Codes of conduct

    • Minimum duration for long-term contracts

    • Available sizes, colours, materials

Article 5: Conclusion and Payment

  1. A contract is formed upon the consumer's acceptance of the offer.

  2. Acceptance by electronic means will be confirmed immediately.

  3. Until confirmation is received, the consumer may withdraw.

  4. Appropriate security measures are taken for electronic transactions.

  5. Payment details and methods are secure.

  6. Lania Boutique may assess the consumer’s ability to meet payment obligations.

  7. Orders may be refused or attached to conditions based on that assessment.

  8. After payment, the consumer will receive:

    • Contact address for complaints

    • Withdrawal rights details

    • After-sales service information

  9. Product availability applies to all offers.

Article 6: Right of Withdrawal

  1. Consumers may cancel the contract within 14 days of receiving the product.

  2. The withdrawal period starts the day after the consumer receives the product.

  3. Products must be returned unused and in original packaging.

  4. Withdrawal must be notified by email to info@laniaboutique.com.

  5. After notification, the consumer must return the goods within 14 days.

  6. Return shipping costs are the consumer’s responsibility.

Article 7: Costs in Case of Withdrawal

  1. Consumers bear the cost of returning goods.

  2. Refunds will be processed within 14 days after withdrawal confirmation.

  3. Refunds may be withheld until the returned goods are received.

Article 8: Exclusion of Right of Withdrawal

Withdrawal may be excluded for:

  • Custom-made products

  • Personalised products

  • Sealed goods (for hygiene reasons) once unsealed

  • Audio/video/software with broken seals

  • Services started with consumer’s consent before the withdrawal period ends

Article 9: Pricing

  1. Prices remain unchanged during the offer validity unless tax rates change.

  2. Prices subject to market fluctuations will be clearly indicated.

  3. Price increases within 3 months are only allowed by legal provisions.

  4. Post-3-month price increases entitle consumers to cancel the contract.

  5. For international orders:

    • No Australian GST is charged upfront.

    • Duties, taxes, and customs clearance fees must be paid by the customer upon delivery.

  6. All prices are subject to typographical errors.

Article 10: Conformity and Warranty

  1. Lania Boutique guarantees that the goods conform to the contract.

  2. Specific use warranties apply if agreed.

  3. Legal consumer rights remain unaffected.

  4. Complaints must be reported within 14 days of delivery.

  5. Manufacturer warranties apply.

  6. Warranty exclusions include:

    • Improper use

    • Third-party modifications

    • Regulatory restrictions

Article 11: Delivery and Performance

  1. Lania Boutique handles orders with care.

  2. Orders ship to the address provided by the consumer.

  3. Deliveries occur within 30 days unless otherwise agreed.

  4. Refunds for contract termination occur within 14 days.

  5. If a product cannot be delivered, an alternative may be offered.

  6. Risk transfers upon delivery to the consumer.

Article 12: Payment Terms

  1. Payments must be made within 7 days unless otherwise agreed.

  2. The consumer must immediately report payment data errors.

  3. Failure to pay may incur statutory charges.

Article 13: Complaints

  1. Complaints must be submitted within 7 days of noticing defects.

  2. Complaints are handled within 14 days.

  3. If a solution cannot be reached, disputes will be escalated.

  4. Submitting a complaint does not suspend obligations unless confirmed in writing.

Article 14: Disputes

All contracts between Lania Boutique and the consumer are governed exclusively by Dutch law, even if the consumer resides abroad.
