Terms and Conditions – Lania Boutique
Article 1: Definitions

Withdrawal period: The period in which the consumer can withdraw from the contract without giving any reason.

These terms apply to every offer, agreement, and distance order between Lania Boutique and the consumer.

If it is not reasonably possible to provide the terms beforehand, it will be indicated where they can be inspected.

In the case of electronic contracts, the terms can be provided digitally for easy storage.

In case specific product or service conditions apply, the most favorable provision to the consumer prevails in case of conflict.

If a provision is invalid, the contract remains effective, and a similar provision will replace it.

Article 5: Conclusion and Payment

A contract is formed upon the consumer's acceptance of the offer.

Acceptance by electronic means will be confirmed immediately.

Until confirmation is received, the consumer may withdraw.

Appropriate security measures are taken for electronic transactions.

Payment details and methods are secure.

Lania Boutique may assess the consumer’s ability to meet payment obligations.

Orders may be refused or attached to conditions based on that assessment.

Article 6: Right of Withdrawal

Article 7: Costs in Case of Withdrawal

Refunds will be processed within 14 days after withdrawal confirmation.

Refunds may be withheld until the returned goods are received.
Article 8: Exclusion of Right of Withdrawal
Withdrawal may be excluded for:

Personalised products

Sealed goods (for hygiene reasons) once unsealed

Audio/video/software with broken seals

Services started with consumer’s consent before the withdrawal period ends
Article 9: Pricing

Prices remain unchanged during the offer validity unless tax rates change.

Prices subject to market fluctuations will be clearly indicated.

Price increases within 3 months are only allowed by legal provisions.

Post-3-month price increases entitle consumers to cancel the contract.

For international orders:

No Australian GST is charged upfront.

Duties, taxes, and customs clearance fees must be paid by the customer upon delivery.

All prices are subject to typographical errors.
Article 10: Conformity and Warranty

Article 11: Delivery and Performance

Deliveries occur within 30 days unless otherwise agreed.

If a product cannot be delivered, an alternative may be offered.

Article 12: Payment Terms

Payments must be made within 7 days unless otherwise agreed.

The consumer must immediately report payment data errors.

Failure to pay may incur statutory charges.
Article 13: Complaints

Complaints must be submitted within 7 days of noticing defects.

If a solution cannot be reached, disputes will be escalated.

Submitting a complaint does not suspend obligations unless confirmed in writing.
Article 14: Disputes
All contracts between Lania Boutique and the consumer are governed exclusively by Dutch law, even if the consumer resides abroad.
